Harman Kardon Philippines Privacy Policy.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from harmankardon.com.ph (the “Site”). The personal information controller over the Personal Information collected through or from the Site is Beyond Innovations Inc., doing business as Harman Kardon Philippines, with address at 2nd Floor, Topy Building II. PERSONAL INFORMATION WE COLLECT

When you visit the JBL Store website, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as “Order Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  • Communicate with you;
  • Screen our orders for potential risk or fraud; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We do not generally process your sensitive personal information. In the event that we will collect and/or process your sensitive personal information, we will obtain your consent specific to the purpose of our processing prior to processing such sensitive personal information.

We share your Personal Information with third parties to help us use your Personal Information, as described above. We may share your Personal Data with our Service Providers as necessary to enable them to provide services to us. Service Providers are third parties (other companies and individuals) that support the operation and maintenance of our Services.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights. We rely on the same legal bases for processing (discussed above) when we share your Personal Information.

DATA RETENTION

When you place an order through the Site, we will maintain your Order Information for our records for as long as your account (if any) is active, or for as long as necessary for the fulfillment of the purposes specified in this Privacy Policy, or when the processing relevant to said purposes has been terminated, for the establishment, exercise or defense of legal claims, or for legitimate business purposes, unless and until you ask us to delete this information.

YOUR RIGHTS

You have the following rights in relation to your Personal Information under applicable laws: 

Right to access. You have the right to request access to your Personal Information. This enables you to receive a copy of the Personal Information we hold about you and to check that we are lawfully processing it.

Right to rectification. You have the right to request the correction of the Personal Information we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, although we may need to verify the accuracy of the new data you provide to us. We will ensure that the Personal Information in our possession is accurate and complete to the best of our knowledge. You agree to only submit Personal Information which is accurate and not misleading and to keep it up to date. We may verify the Personal Information provided by you as part of our user verification processes or as required under applicable law.

Right to object. You have the right to object to the processing of your Personal Information where we are relying on your consent or a legitimate interest and you object to the processing of your personal data on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object to our further processing of your Personal Information where we have made significant changes to this Privacy Policy, or where we are processing your Personal Information for direct marketing purposes. However, in certain cases, we may demonstrate that we have compelling legitimate grounds under law to process your Personal Information, which will override your objection. 

Please note that if you choose to withdraw your consent to our use, disclosure, transfer and/or processing of your Personal Information, we may not be able to provide you with some or all of our goods and services. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Information where such collection, use and disclosure without consent is permitted or required under applicable laws.

Right to erasure or blocking. You have the right to request for the erasure, blocking or withdrawal of your Personal Information. This enables you to ask us to delete or remove personal data, or suspend the processing of your Personal Information, where you believe that your Personal Information or our processing thereof (a) is incomplete, outdated, false or unlawfully obtained, (b) used for unauthorized purposes, (c) no longer necessary for the purposes set out in this Privacy Policy, or (d)  otherwise prejudicial to you. You may also exercise this right when you have successfully exercised your right to object to processing, where we may have processed your Personal Information unlawfully or where we have violated your rights as a data subject.  Note, however, that we may require substantial proof of any of the following, and we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Right to data portability. You have the right to request the transfer of your Personal Information to you or to a third party in in a structured, commonly used, machine-readable format. Note that this right only applies to information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Right to redress. In the event that you feel that any of your rights as a data subject under applicable law have been violated, you have the right to lodge a complaint with the National Privacy Commission and/or, upon proof, to be indemnified for any damages sustained due to such violation. Please note that we may in accordance with applicable law, charge you a reasonable fee to process your access request. If so, we will inform you of the fee before processing your request. 

We will comply with your request within 30 working days after receipt of your request and/or your submission of the necessary supporting or additional documentation. In case, however, that your request is complex or numerous, we reserve the right to extend this period by another 15 working daysand we will notify you of the reason for such extension.

CHANGES

We may update this privacy policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
